UN Court Orders Israel to Open More Land Crossings for Gaza Aid

The Hague, Netherlands, March 28 (AP) - The International Court of Justice (ICJ), the principal judicial organ of the United Nations, has mandated Israel to implement immediate measures to alleviate the severe shortages in Gaza by facilitating the entry of essential supplies such as food, water, fuel, and medical supplies. This directive comes in light of a lawsuit filed by South Africa, which accuses Israel of engaging in acts of genocide through its military operations initiated post the October 7 attacks by Hamas. Israel has vehemently refuted these allegations, asserting that its military actions are in self-defense.

Israel to Open More Gaza Aid Crossings

Following South Africa's appeal for additional provisional measures, including a ceasefire to address the dire humanitarian situation in Gaza, the ICJ's legally binding order emphasizes Israel's obligation to ensure "the unhindered provision at scale by all concerned of urgently needed basic services and humanitarian assistance." Moreover, the court has instructed Israel to prevent any military actions that could infringe upon Palestinians' rights under the Genocide Convention, specifically actions that obstruct the delivery of crucial humanitarian aid.

Israel is required to report on the execution of these orders within a month. The Israeli Foreign Ministry has yet to comment on this development. Previously, Israel criticized South Africa's request for further measures as baseless and offensive, accusing it of misusing both the Genocide Convention and the court itself.

Despite initial restrictions on Gaza's borders early in the conflict, Israel claims to have allowed humanitarian supplies into Gaza without limiting quantities. However, the UN and various aid organizations argue that Israeli military restrictions, continued hostilities, and public order breakdown have hampered aid deliveries. In response to these challenges, Israel is coordinating with international partners to initiate aid deliveries by sea.

Israel's contentious relationship with the United Nations, particularly with UNRWA (the UN agency for Palestinian refugees), has been highlighted amidst these developments. Israel accuses UNRWA of collusion with Hamas, an allegation the agency denies.

The ICJ's recent order underscores the grave situation in Gaza, where famine is no longer a looming threat but a current reality. Citing a report from the United Nations Office for the Coordination of Humanitarian Affairs, the court noted that malnutrition and dehydration have already resulted in at least 31 deaths, including 27 children. This stark revelation indicates that previous orders have not sufficiently addressed the deteriorating conditions in Gaza.

Despite claims from the Israeli military about readiness to facilitate unlimited aid into Gaza, bottlenecks persist due to distribution challenges faced by international aid organizations. A recent statement from the army highlighted an inspection of 258 aid trucks, out of which only 116 were distributed within Gaza by the UN. COGAT, the Israeli military body responsible for Palestinian civilian affairs, has been experimenting with pilot programs to inspect humanitarian aid at Israel's main checkpoints and then utilize land crossings in central Gaza to deliver aid to the northern part of the Strip. COGAT has not commented on the ICJ ruling as of now.
