Trump Seeks Dismissal of Georgia Election Case, Citing Presidential Immunity and Jurisdiction Issues
Donald Trump, the President-elect, is seeking to have the Georgia election interference case against him dismissed. He argues that once he assumes the presidency next month, state courts will lack jurisdiction over him. The case is largely paused due to a pretrial appeal concerning prosecutor Fani Willis's involvement, which Trump's defense claims is a conflict of interest.

Trump's legal team has filed a notice with the Georgia Court of Appeals. They argue that a sitting president is "completely immune from indictment or any criminal process, state or federal." They request the court to determine its jurisdiction before Trump assumes office next month. The filing insists that both the appeals and trial courts lack jurisdiction, deeming the indictment and prosecution unconstitutional.
Legal Challenges and Jurisdiction Issues
Trump's attorneys are urging the appeals court to dismiss his appeal for lack of jurisdiction. They also want the trial court to immediately dismiss the indictment against him. Meanwhile, former Trump campaign lawyer Kenneth Chesebro, who pleaded guilty to conspiracy charges in this case, is seeking to invalidate his plea.
Chesebro was among four individuals who pleaded guilty following the indictment. His lawyer has requested Fulton County Superior Court Judge Scott McAfee to nullify the plea after McAfee dismissed the charge Chesebro admitted to in September. Chesebro's attorney argues that maintaining his plea violates his constitutional right to due process.
Conflict of Interest Allegations
Fulton County District Attorney Fani Willis has faced requests for removal from Trump and other defendants. They claim her past romantic relationship with Nathan Wade, a special prosecutor she appointed, creates a conflict of interest. Willis and Wade acknowledged their relationship but stated it began after Wade's hiring and ended before Trump's indictment.
Judge McAfee ruled that Willis exhibited poor judgment but found no conflict of interest warranting her disqualification. He allowed her to continue prosecuting as long as Wade stepped aside, which he did. The appeal of this ruling remains pending and must be resolved by March.
Chesebro's Legal Proceedings
In August 2023, Chesebro was charged alongside Trump and 17 others in an indictment alleging efforts to overturn Trump's 2020 election loss in Georgia. He later pleaded guilty to conspiracy after reaching a deal with prosecutors just before trial. Prosecutors allege Chesebro was involved in a scheme where 16 Georgia Republicans falsely claimed Trump won Georgia.
Chesebro admitted guilt in October 2023 to one felony charge related to filing false documents with a federal court in Atlanta. Judge McAfee's September ruling stated punishing someone for filing certain documents could limit federal court proceedings' scope and impair justice administration.
The judge concluded that the charge must be quashed as it exceeded state jurisdiction. Representatives for District Attorney Willis have declined to comment on Trump's and Chesebro's requests.
