Philadelphia District Attorney Sues Elon Musk's America PAC Over USD 1 Million Giveaway Linked to Election Integrity

Philadelphia's district attorney has initiated legal proceedings to stop Elon Musk's USD 1 million daily giveaway, linked to his political group's support for Donald Trump's presidential campaign. This lawsuit, filed by Democratic District Attorney Larry Krasner, is the first legal challenge against the America PAC's sweepstakes, which offers USD 1 million daily until November 5 to individuals in battleground states who sign a petition supporting the Constitution.

A spokesperson for Musk's America PAC, when asked about the lawsuit and whether the cash prizes would continue, provided a link to an X post. The post displayed the latest USD 1 million winner holding a large cheque. Krasner's office clarified that this lawsuit does not rule out potential criminal charges, emphasizing their role in safeguarding public interests from illegal lotteries and election interference.

Legal Concerns Over Sweepstakes

Election law experts have expressed concerns that this initiative might breach federal laws prohibiting payments for voting or voter registration. The requirement for contestants to be registered voters in specific battleground states raises questions. However, the lawsuit focuses on the operation of a lottery rather than vote-buying. "This case is very simple because America PAC and Musk are indisputably violating Pennsylvania's statutory prohibitions against illegal lotteries and deceiving consumers," the suit states.

The lawsuit highlights deceptive practices, such as not providing complete contest rules, including odds of winning and winner selection details. Musk portrays the money as both a prize and compensation for serving as a spokesperson for the group. Despite these legal challenges, some attendees at Musk's events view the giveaway positively.

Public Reactions and Political Context

Michele Costantino, a retired health care administrator from Elverson, Pennsylvania, described the giveaway as a "good idea." She commented outside Musk's rally in Lancaster, "I think he's playing the same game as the other side." Meanwhile, President Joe Biden criticized the giveaway as "totally inappropriate" after voting in Delaware on Monday.

Reflecting Pennsylvania's significance in the election, both Harris and Trump have recently visited the state multiple times. Trump's appearances included a photo opportunity at a suburban Philadelphia McDonald's, while Harris visited a church and barbershop in Philadelphia on Sunday.

Musk has committed over USD 70 million to his super PAC to support Trump and other Republicans in November. He believes civilisation is at risk if Trump loses. The woman who received the USD 1 million cheque from Musk on stage in Lancaster declined to comment afterward, stating she was asked to leave before the event concluded.

Musk's giveaway requires participants to sign a petition endorsing the First and Second Amendments of the Constitution. Winners must also agree to act as spokespeople for the organization. As Election Day approaches, this legal battle adds another layer of complexity to an already contentious political landscape.
