The incident unfolded during the early hours of Sunday when police officers were called to respond to reports of gunfire near a hotel area. Around 12:15 am on Sunday, Bismarck police received alerts about gunshots fired in their vicinity. As they arrived at the scene, it was confirmed that a shooting had indeed taken place near a local hotel. The investigation quickly pointed towards Nicholas Bruington, aged 17 and from Bismarck itself, as the primary suspect involved in this case.

The stop took place near Scheels sporting goods store located within Kirkwood Mall's parking lot. According to Lt. Luke Gardiner's statement, during this encounter with law enforcement officials, Bruington was armed and allegedly failed to comply with their commands. Although details remain unclear whether he aimed his weapon at the officers or not, what ensued led to three officers discharging their firearms towards him.
