Biden Administration Bypasses Congress, Approves Urgent Ammunition Sale to Israel
The Biden administration has authorized the urgent sale of tank ammunition to Israel, bypassing congressional review, to support Israels military operations in the Gaza Strip.
In a move that bypasses Congressional approval, the Biden administration has authorized the emergency sale of nearly 14,000 rounds of tank ammunition to Israel, valued at over $106 million. This decision comes amidst Israel's intensified military operations in the southern Gaza Strip and coincides with President Joe Biden's request for a substantial aid package for Ukraine, Israel, and other national security concerns, which currently faces delays in Congress due to debates over U.S. immigration policy and border security.

Congressional Concerns and Emergency Sale
Certain Democratic lawmakers have expressed their intention to link the proposed $14.3 billion in American assistance to Israel with concrete actions by Prime Minister Benjamin Netanyahu's government to minimize civilian casualties in Gaza during conflicts with Hamas. However, the State Department notified Congress of the sale on Friday after Secretary of State Antony Blinken determined that an urgent need existed, necessitating the immediate sale of the munitions in the interest of U.S. national security. This decision allows the purchase to bypass the customary congressional review process for foreign military sales.
Justification and Sale Details
The State Department emphasized the United States' commitment to Israel's security and the significance of assisting Israel in developing and maintaining a robust self-defense capability. The proposed sale aligns with these objectives and aims to serve as a deterrent against regional threats and bolster Israel's homeland defense. The sale, valued at $106.5 million, encompasses 13,981 120 mm High Explosive Anti-Tank Multi-Purpose with Tracer tank cartridges, along with U.S. support, engineering, and logistics. The materiel will be sourced from the Army's inventory.
Bypassing Congress: A Controversial Practice
Bypassing Congress through emergency determinations for arms sales is an uncommon step that has previously faced resistance from lawmakers. Typically, lawmakers are granted a period to evaluate proposed weapons transfers and, in certain instances, block them. In 2019, then-Secretary of State Mike Pompeo employed an emergency determination for an $8.1 billion arms sale to Saudi Arabia, the United Arab Emirates, and Jordan. This decision drew criticism due to concerns about the Saudi-UAE-led war in Yemen and the fact that many of the weapons involved were yet to be manufactured and could not be delivered urgently. However, Pompeo was cleared of any wrongdoing following an internal investigation.
Historical Precedents
The authority to bypass Congress for arms sales has been utilized by at least four administrations since 1979. Notably, President George H.W. Bush's administration employed this authority during the Gulf War to swiftly provide arms to Saudi Arabia.
