Judge Rejects Alex Murdaughs Bid for New Trial Despite Jury Tampering Claims

In a significant development, a South Carolina judge has denied Alex Murdaugh's request for a new trial after his defense team raised concerns about potential jury tampering by a court clerk. Judge Jean Toal expressed skepticism about the veracity of Colleton County Clerk Becky Hill's claims that she never engaged in any discussions with jurors regarding the case, suggesting that she may have been influenced by the allure of celebrity.

Jurors Testify on External Influences
Despite Toal's reservations about Hill's credibility, she emphasized that all 12 jurors who testified during the hearing maintained that any comments made by Hill did not directly impact their decision to find Murdaugh guilty. The jurors, who traveled from Colleton County to Columbia for the hearing, provided brief testimonies, primarily answering yes-or-no questions posed by the judge.
Murdaugh's Presence and Hill's Testimony
Murdaugh, now serving a life sentence as a convicted murderer, disbarred attorney, and admitted thief, attended the hearing wearing an orange prison jumpsuit. Meanwhile, Hill took the stand and vehemently denied ever discussing the case or Murdaugh with any jurors. However, her credibility was called into question when she admitted to taking literary liberties in her book about the trial, including expressing her personal feelings as the verdict was being read.
Conflicting Statements and Motivations
The defense presented additional witnesses, including Barnwell County Clerk Rhonda McElveen, who assisted Hill during the trial. McElveen revealed that Hill had proposed collaborating on a book about the case prior to the trial, citing financial motivations such as purchasing a lake house and securing retirement. Under cross-examination, McElveen admitted that she did not report Hill's comments or behavior to the trial judge, as she did not perceive them as misconduct.
Juror's Sworn Statement Raises Concerns
The hearing was prompted by a sworn statement from the first juror called to the stand, who reiterated her previous claims that Hill had instructed jurors to closely observe Murdaugh's actions during his testimony. The juror, identified as Juror Z, felt that Hill's comments implied Murdaugh's guilt. While acknowledging that Hill's statements influenced her decision, she also emphasized the influence of fellow jurors in shaping her vote.
Remaining Jurors' Perspectives
The remaining jurors who testified consistently maintained that their verdicts were not influenced by any external factors beyond the trial proceedings. One juror recalled Hill's comment to "watch his body language" before Murdaugh's testimony, but clarified that it did not alter his decision.
Defense Attorney's Optimism
Despite the judge's denial of a new trial, Murdaugh's defense attorney, Jim Griffin, expressed optimism that Toal's acknowledgment of Hill's lack of credibility could ultimately lead to an overturned conviction on appeal. Griffin asserted that an innocent man had been wrongly convicted and expressed surprise at Toal's assessment of Hill's credibility.
