OI Exclusive | Uttarakhand Waqf Board Chairman Proposes Dissolution Amid Uniform Civil Code Implementation
In a landmark statement regarding the upcoming implementation of the Uniform Civil Code (UCC) in Uttarakhand, Shadab Shams, Chairman of the Uttarakhand Waqf Board, has expressed intentions to formally request the dissolution of the board once the UCC comes into effect.
In an exclusive interview with One India, Shams articulated his belief that the Waqf Board would no longer hold relevance under a unified legal framework that applies equally to all citizens.

Embracing Change: A Step Toward Equality
Shams commended the Dhami government's initiative to implement the UCC, labelling it a historic and progressive move that aims to benefit all segments of society. He emphasized that under the UCC, all citizens would be governed by the same set of laws, rendering institutions like the Waqf Board, which primarily serve specific religious communities, unnecessary. Shams noted, "The UCC is a step that will help create a more cohesive society, where everyone is subject to the same legal standards."
Despite his supportive stance on the UCC, Shams acknowledged the challenges he faces from various religious leaders who may resist such changes. He stated that his advocacy for dissolving the Waqf Board has often met with opposition, and he expects similar pushback following his recent announcement. However, he remains committed to the idea that a unified legal system would foster greater societal harmony.
Rapid Progress Towards UCC Implementation
The Uttarakhand government is making significant strides in implementing the UCC. An expert committee, formed specifically to draft the guidelines for the UCC, recently submitted its report to Chief Minister Pushkar Singh Dhami. This committee, led by retired Supreme Court judge Ranjana Prakash Desai, has played a pivotal role in shaping the UCC framework for the state. Sources indicate that Uttarakhand could potentially be the first state in India to enforce the UCC, with implementation likely by November 9, aligning with the state's Foundation Day.
Chief Minister Dhami's Commitment to UCC
Since taking office, Chief Minister Dhami has prioritized the introduction of the Uniform Civil Code as a key aspect of his governance. In his first Cabinet meeting on May 27, 2022, Dhami announced the establishment of the five-member committee tasked with drafting the UCC guidelines. With the committee's draft now finalized, the state government is swiftly completing the necessary legal and procedural formalities required for the UCC's rollout.
The Broader Implications
The introduction of the UCC in Uttarakhand has far-reaching implications not only for the Waqf Board but also for various religious institutions and communities across the state. The UCC aims to standardize personal laws related to marriage, divorce, inheritance, and adoption, thereby ensuring that all citizens are treated equally under the law, regardless of their religion.
As Uttarakhand moves closer to this transformative legal shift, the community is poised to witness changes that could reshape the social and legal landscape. Shams' proposal to dissolve the Waqf Board highlights the potential for a more unified and equitable society, although it also underscores the complexities involved in reconciling traditional practices with modern legal frameworks.
With the implementation of the UCC on the horizon, stakeholders across various sectors will need to engage in dialogue and collaboration to navigate the transition successfully. The state government is expected to address concerns from various communities while promoting the principles of equality and justice that underpin the UCC.
As this significant change unfolds, the eyes of the nation will be on Uttarakhand, watching how the implementation of the UCC will set a precedent for other states considering similar reforms.
