NHRC Directs States to Investigate Inhumane Treatment of Roadside Vendors by Municipal Authorities
The NHRC has issued notices to states and Union territories regarding complaints of inhumane treatment of roadside vendors by municipal authorities. The rights panel has called for an inquiry into these allegations, highlighting the impact on vendors' earnings during festive seasons.
The National Human Rights Commission (NHRC) has issued notices to all states and Union territories following a complaint about the mistreatment of roadside vendors and hawkers by municipal authorities. The complaint alleges that these vendors face unnecessary and harsh treatment across various cities. The NHRC has ordered an investigation into these claims, as per the proceedings of a case before its bench.

The complainant claims that municipal authorities are evicting vendors under the pretext of clearing paths for emergency services like fire brigades and ambulances. However, it is alleged that the real motive is to harass these vendors. The proceedings dated October 17 mention that vendors are being fined or extorted for money, with local shopkeepers allegedly colluding in these actions.
Human Rights Violations Alleged
The NHRC has noted that these allegations appear to violate the human rights of the affected vendors. The commission's bench, led by member Priyank Kanoongo, has taken cognisance under section 12 of the Protection of Human Rights Act, 1993. The NHRC has instructed the registry to issue notices to the chief secretaries of all states and Union territories to investigate the complaint's allegations.
In its notice, the NHRC highlighted that such actions by authorities contradict the government's Vocal for Local initiative. It has directed district magistrates and municipal authorities to refrain from such acts. Additionally, arrangements for fire-fighting measures should be made at prominent locations to ensure access during emergencies in fire-prone areas.
Alternative Arrangements for Vendors
The NHRC has also directed that if vendors need to be displaced from footpaths due to emergency service access issues, they should be provided with suitable alternative locations. These substitute places must be equipped with all necessary safety measures. Furthermore, no penalties or harsh actions should be taken against these vendors during the Diwali festive season by local administrations.
The NHRC emphasised that these directions are specific to Diwali and should not be misused throughout the year. An action taken report is expected within two weeks from the concerned authorities. This step aims to ensure that vendors can earn their livelihood without undue interference during this crucial festive period.
