Madras High Court Says Politicians Act Like Kings, Condemns Vulgar Speech

The Madras High Court has issued a stern warning to former DMK Minister K Ponmudy for his offensive comments about Vaishnavites, Saivites, and women from the general category. The court indicated that if the Tamil Nadu police do not take action, a CBI investigation might be initiated. Ponmudy's remarks were made during an event in April, where he linked Hindu religious identities with sexual positions.

Justice Velmurugan, while hearing a suo motu writ petition, expressed concern over politicians exploiting Article 19. "Nowadays these politicians feel that sky's the limit under Article 19. We can't be mere spectators. We live in a democracy with many communities," he remarked. He emphasised that India is a nation for everyone, not just politicians.

Politicians' Responsibility in Public Discourse

Justice Velmurugan further highlighted the responsibility of politicians when addressing the public. He stated that they should remember they are part of a diverse society and not act as if they are above others. "Everyone must realise that they're living among the people," he added.

The judge criticised the tendency of some leaders to speak as though they are untouchable figures of authority. "Everyone is taking the mic and saying so many things as if they're the king. As if no one can do anything against the king," he noted, stressing that such behaviour cannot be tolerated by the court.

Viral Video Sparks Outrage

A video from Ponmudy's public event went viral, capturing him making inappropriate jokes about religious identities and sexual positions. In it, he addressed women directly before narrating an anecdote involving a man visiting a sex worker who questions his religious affiliation based on tilak styles.

The joke involved asking whether the man wore a pattai (horizontal tilak) or naamam (vertical tilak), associated with Shaivism and Vaishnavism respectively. The sex worker then explained that Shaivites prefer lying down while Vaishnavites prefer standing up.

Legal Proceedings and Future Actions

Justice Velmurugan acknowledged this case as unprecedented in its nature and has scheduled further proceedings for August 1. The court's intervention underscores its commitment to maintaining decorum in public discourse and holding individuals accountable for derogatory statements.
