Unprecedented Move: Kerala HC Allows Life Convict Leave For IVF Treatment, Emphasizes Rehabilitation Over Punishment

The plea was heard by Justice P V Kunhikrishnan who expressed empathy towards the couple's desire to have a child. He further noted that once an individual has served their sentence, they should not be treated differently from other citizens. Therefore, he opined that authorities should grant at least 15 days' leave to the petitioner’s husband for continuing IVF/ICSI procedure/treatment.

This landmark order was given recently directing the Director General of Prisons and Correctional Services to permit the man for undergoing IVF treatment as per law as swiftly as possible within two weeks from date of receipt of certified copy of this order.
