High Court in J&K Demands Information on Politicians' Retention of Govt. Accommodations
The High Court of Jammu & Kashmir and Ladakh has ordered an inquiry into the personal accommodations of 48 politicians who have retained government facilities in Jammu and Srinagar. The order was issued by a division bench comprising Chief Justice N Kotiswar Singh and Justice Rajesh Sekhri on Friday, September 15. This ruling comes as a response to a Public Interest Litigation (PIL) filed by Professor SK Bhalla.
Unauthorised Retention of Government Accommodations

In his PIL, Prof Bhalla brought attention to the alleged unauthorised retention of various government accommodations including ministerial bungalows, flats, quarters in Jammu and Srinagar by former ministers and legislators. He argued that these individuals were illegally occupying these properties following the dissolution of the then state assembly in June 2018.
The petition also called for action from the estates department to ensure eviction of these illegal occupants. Prof Bhalla's plea seeks not only justice but also aims to promote transparency within governmental operations.
Directions Issued by the Bench
To gain clarity over this issue, the bench directed SS Ahmed, learned counsel for the petitioner, to furnish a list containing names of those persons who possess houses either in Jammu or Kashmir as mentioned in Annexure-R1 attached with status report filed on March 28 this year under regulation 5 of regulations 2004 referred above.
The court further instructed Senior Additional Advocate General SS Nanda, representing the estates department, to provide a detailed report determining whether any person named on this list possesses alternative accommodation. This step is crucial as it will help determine if there is any merit behind their continued occupation of government facilities despite having private residences at their disposal.
