Congress MP, AIMIM’s Asaduddin Owaisi challenge Waqf Bill In Supreme Court

Congress MP Mohammad Jawed and AIMIM president Asaduddin Owaisi have approached the Supreme Court challenging the Waqf (Amendment) Bill, 2025. The Bill was passed in the Rajya Sabha on Thursday with 128 members voting in favour and 95 against it. It had earlier cleared the Lok Sabha on April 3, where 288 members supported the Bill while 232 opposed it.

In his plea, Congress MP Mohammad Jawed argued that the Bill imposes arbitrary restrictions on Waqf properties and their management, thereby infringing upon the religious autonomy of the Muslim community. Filed through advocate Anas Tanwir, the petition further claims that the legislation is discriminatory as it subjects Waqf properties to controls not applicable to other religious endowments.

Asaduddin Owaisi, in a separate plea, contended that the provisions of the Waqf (Amendment) Bill, 2025, fundamentally violate the rights of Muslims and the broader Muslim community. His petition, according to Live Law, asserts that the Bill curtails constitutional guarantees and undermines established rights related to religious practices and property.

Meanwhile, senior Congress leader Jairam Ramesh announced that the Indian National Congress would soon formally challenge the constitutional validity of the Waqf (Amendment) Bill, 2024, in the Supreme Court. In a statement shared on social media, he stated, "The INC will very soon be challenging in the Supreme Court the constitutionality of the Wakf (Amendment) Bill, 2024. We are confident and will continue to resist all assaults of the Modi Govt on the principles, provisions, and practices that are contained in the Constitution of India."

Ramesh also listed previous legal challenges by the Congress, including cases against the Citizenship (Amendment) Act, 2019, the 2019 amendments to the Right to Information Act, and the Conduct of Election Rules (2024). He added that the party is also pursuing matters concerning the Places of Worship Act, 1991.
