Amid Debate Over Bengaluru Techie Case, SC's 8-Point Guide To Alimony

The Supreme Court has issued an eight-point guideline to determine alimony amounts, sparking discussions in the wake of Bengaluru-based techie Atul Subhash's tragic suicide.

Atul, originally from Bihar, accused his wife Nikita Singhania and her family of harassment and extortion in an 80-minute video and a 24-page suicide note. He alleged they filed multiple legal cases against him and his family to demand exorbitant settlements.

Supreme Court's Alimony Guidelines:
A bench comprising Justice Vikram Nath and Justice PV Varale detailed factors to be considered while determining alimony, which include:

  • Social and economic status of both spouses.
  • Basic needs of the wife and children.
  • Employment and qualifications of both parties.
  • Income, property, and living standards of the wife during her marital stay.
  • Whether the wife left employment for family responsibilities.
  • Legal expenses for a non-working wife.
  • Husband's financial capacity and responsibilities post-alimony.
  • The court emphasized the balance between ensuring a fair standard of living for the wife and not overburdening the husband.

Dowry Law Misuse Observations:
In a separate case, a bench led by Justices BV Nagarathna and N Kotiswar Singh dismissed a dowry case, acknowledging that such laws are sometimes exploited for personal vendettas.

Atul Subhash's Case:
Atul married Nikita in 2019 after meeting on a matchmaking platform. They had a son in 2020. Atul alleged Nikita's family frequently demanded large sums of money, starting at Rs 1 crore and later escalating to ₹3 crore. He claimed Nikita left their Bengaluru home with their son in 2021 after he refused to pay.

In his note, Atul criticized the justice system and pleaded for fairness, writing "Justice is Due" on every page. His case has reignited debates over the misuse of dowry laws and the pressures faced by individuals in such disputes.

The tragedy serves as a grim reminder of the complexities surrounding marital disputes and the need for balanced legal interventions.
