TVS wins back right to sell 'Flame'
New Delhi, Sep 17: In the dispute between two auto giants, TV motors and Bajaj Auto Limited over the manufacturing and marketing of TVS bike 'Flame', the Supreme Court ruled in favour of TVS motors.
The Supreme Court on Wednesday, Sep 16 pronounced its judgment to the Special Leave Petitions filed by Bajaj Auto Limited against the Madras High Court order, in which the apex court held the High Court order that TVS is entitled to sell its product 'Flame'.
Earlier in May 2009, Madras High Court had allowed TVS" application for an interim injunction restraining Bajaj from in any way interfering with the manufacture and marketing of TVS" products.
Apart from this, the Supreme Court has directed TVS to maintain and file accounts of sales which would be verified by a receiver to be appointed by the Madras High Court.
Further, the Court has directed that the suit before the Madras High Court be heard on a day to day basis on commencement after Dassehra vacations and that the hearing be concluded by 30th Nov 2009.
Bajaj had disputed TVS' right on using internal combustion engines with three valves and two spark plugs in DTSi patent infringement case.
