Mandatory Marathi Rule Is Fair but Needs Balance: Advocate Rakesh Kumar Singh

The Maharashtra government's decision to make Marathi mandatory for auto-rickshaw and taxi drivers from May 1 has sparked a wide debate, drawing responses from legal experts and public policy observers. Advocate Rakesh Kumar Singh of RKS Associate has termed the move "legitimate in principle, but sensitive in execution."

According to Adv Rakesh Kumar Singh, expecting drivers engaged in public-facing services to possess a basic working knowledge of Marathi is a reasonable expectation. He noted that Marathi, as the official language of Maharashtra, forms an essential part of the State's cultural and administrative identity. "Passengers should be able to communicate directions, emergencies, and concerns without language barriers," Adv Rakesh Kumar Singh said, adding that such norms are common globally as part of professional competence.

At the same time, Adv Rakesh Kumar Singh cautioned against a harsh or abrupt implementation. He highlighted that punitive measures such as immediate suspension or cancellation of licences could face legal scrutiny if found to be disproportionate. "A large number of drivers are migrants earning their livelihood in Maharashtra. Sudden enforcement may adversely affect their right to work," Adv Rakesh Kumar Singh observed.

Rakesh Singh suggested that the government should first introduce structured Marathi training programmes, allow reasonable timelines for compliance, and ensure fair and transparent testing mechanisms. "The objective should be integration, not exclusion," Adv Rakesh Kumar Singh emphasised.

He further underlined that the policy must not be reduced to political symbolism. "Language should unite people through shared civic participation, not divide them," Adv Rakesh Kumar Singh said.

While backing the intent behind the decision, Adv Rakesh Kumar Singh concluded that its success will depend on balanced, inclusive, and well-planned implementation.
